Hart Car Rentals: Rideshare Driver Terms and Conditions

1. Introduction

Welcome to Hart Car Rentals. By accessing and using our rideshare services, you agree to comply with and be bound by the following terms and conditions. Please review these terms carefully. If you do not agree with any of these terms, you should not use our services.

2. Rental Requirements

  • Valid driver’s license.

  • Minimum age requirement: 21 years old.

3. Booking and Payment

  • All bookings must be made through our website or by contacting us directly.

  • We accept debit and credit card payments through our secure system.

  • Promotion: Our "1 Week Free" promotion for rideshare drivers must be redeemed by using coupon code "1FREEWEEK". This promotion is valid for a limited time and may be discontinued at any time at Hart Rentals LLC's discretion. Customers remain responsible for sales tax (10.6%) and a $300 refundable security deposit. To redeem the coupon, a minimum booking of 7 days is required.

A $300 deposit will be requested prior to confirming your rental and will be held on your credit/debit card until the return of the rental vehicle. The deposit will be released after the return of the rental vehicle, less any incidental charges incurred (gas, tolls, unpaid citations, insurance deductible, rental extensions, or other applicable fees per the accepted terms of the rental agreement).

By redeeming this promotion, you'll have the opportunity to enter into our rideshare program after your first free week where you can choose between weekly or monthly payments on a car rental of your choice. Monthly payments come with a 12.5% discount compared to weekly payments.

4. Rideshare Program Payment Options

  • Weekly Payments:

    • Tesla Model 3: $400 per week

    • Tesla Model Y: $450 per week

    • Toyota Prius: $300 per week

  • Monthly Payments (12.5% Discount):

    • Tesla Model 3: $1,400 per month (compared to $1,600 for 4 weeks)

    • Tesla Model Y: $1,500 per month (compared to $1,800 for 4 weeks)

    • Toyota Prius: $1,000 per month (compared to $1,200 for 4 weeks)

Payments must be made on time. A late fee of 20% will be applied after 24 hours. If payment is not made within 48 hours, the vehicle will be repossessed.

5. Fuel and Electric Charge Policy

Refueling of gas and recharging of electric vehicles is the renter’s responsibility. If the vehicle is not refueled/charged to the level it was given, a fee of 2x the price of gas/electricity will be charged.

Our Quick Refuel & Recharge Return add-on option allows you to return the rental vehicle without a full tank of gas or a full charge for a one-time $60 fee.

6. Cancellation Policy

There are no cancellation fees for reservations canceled more than 72 hours prior to delivery or pick-up. Cancellations within 72 hours of the reservation will be penalized with 50% of the reservation total. If guest cancels within 6 hours of the reservation they will receive no refund.

7. No Show Policy

If the guest does not show up within 30 minutes of their reserved time, we may cancel the reservation with no refund.

8. After Hours Pick-Up or Drop-Off

Our business hours are Monday – Friday, 8:00 AM – 6:00 PM, and Saturday & Sunday, 9:00 AM – 4:00 PM. We accommodate rentals after normal business hours for a nominal fee.

9. Mileage and Maintenance

  • Unlimited Miles: Drive as much as you need without worrying about mileage limits.

  • Standard Maintenance: We cover standard maintenance costs, including oil changes and tires (except for damages caused by user negligence, such as running over a nail).

10. Additional Costs

  • Fuel/Electricity: Drivers are responsible for fuel and electric charges.

  • Fees:

    • Smoking in the vehicle: $350

    • Cleaning Fee: $200

  • Return Charges:

    • Over 80% charge: No charge

    • 50%-80% charge: $25

    • Under 50% charge: $50

    • Low Gas: $8 per gallon

11. Insurance and Damage

  • Insurance: Drivers must have a valid insurance policy that includes the rented vehicle.

  • Damage Responsibility: Drivers are responsible for any damages to the vehicle not covered by standard maintenance.

12. Compliance and Additional Fees

Unlike large corporate rental companies, we do not include unnecessary fees. Our fees are necessary to remain compliant, legal, and operationally effective, ensuring the best service possible.

13. Terms of the Rideshare Program

By redeeming this promotion, you agree to be contacted about the opportunity to join our rideshare program after your first free week, where you can choose between weekly or monthly payments.

14. Definitions

“Agreement" means all terms and conditions found on both sides of this form. "You" or "your" means the person identified as the customer elsewhere in this Agreement, any person signing this Agreement, any Authorized Driver, and any person or organization to whom charges are billed by us at its or the customer's direction. All persons referred to as "you" or "your" are jointly and severally bound by this Agreement.

''We", "our" or "us” means Hart Car Rentals. “Authorized Driver” means the renter and any additional driver listed by us on this Agreement, provided that person has a valid driver's license and is at least age 21. Only Authorized Drivers may operate the Vehicle.

15. Condition and Return of Vehicle

You must return the Vehicle to our rental office on the date and time specified in this Agreement, and in the same condition that you received it, except for ordinary wear. If the Vehicle is returned after closing hours, you remain responsible for the safety of, and any damage to, or loss of, the Vehicle until we inspect it upon our next opening for business.

16. Responsibility for Damage or Loss; Reporting to Police

You are responsible for all loss or theft of, or damage to, the Vehicle, which includes the cost of repair, or the actual cash retail value of the Vehicle on the date of the loss if the Vehicle is not repairable or if we elect not to repair the vehicle, plus loss of use, diminished value of the Vehicle caused by damage to it or repair of it, and our administrative expenses incurred processing the claim. You must report all accidents or incidents of theft and vandalism to us and the police as soon as you discover them.

17. Breach of Agreement

The acts listed here are prohibited uses of the rental vehicle. Any loss or damage that:

  • Is caused by anyone who is not an Authorized Driver, or by anyone whose driving license is suspended in any jurisdiction.

  • Is caused by anyone under the influence of prescription or non-prescription drugs or alcohol.

  • Occurs while the Vehicle is used in furtherance of any illegal purpose or under any circumstance that would constitute a violation of law, other than a minor traffic violation.

  • Occurs while carrying persons or property for hire or while pushing or towing anything, or in any race, speed test or contest.

  • Occurs while teaching anyone to drive.

  • Occurs while carrying dangerous or hazardous items or illegal material in or on the Vehicle.

  • Occurs outside the geographic limitations indicated on the reverse.

  • Occurs when it is loaded beyond its capacity.

  • Occurs as a result of driving the Vehicle on unpaved roads.

  • Occurs while transporting more persons than the Vehicle has seat belts, or while carrying persons outside the passenger compartment.

  • Occurs while transporting children without approved child safety seats as required by law.

  • Occurs and the odometer has been tampered with or disconnected.

  • Occurs when the vehicle's fluid levels are low, or it is otherwise reasonable to expect you to know that further operation would damage the vehicle.

  • Is a result of your willful, wanton, or reckless act or misconduct.

  • Occurs and you fail to summon the police to any accident involving personal injury or property damage.

18. Insurance

You are responsible for all damage or loss you cause to others. You agree to provide auto liability, collision, and comprehensive insurance covering you, us, and the Vehicle.

19. Charges

You will pay us, or the appropriate government authorities, on demand all charges due under this Agreement, including but not limited to:

  • Time and mileage for the period you keep the Vehicle.

  • Optional products and services you purchased.

  • Fuel, if you return the Vehicle with less fuel than when rented.

  • All parking, traffic, and toll violations, fines, penalties, forfeitures, court costs, towing, impound, and storage charges involving the Vehicle unless these expenses are our fault.

  • A reasonable fee not to exceed $350 to clean the Vehicle if returned substantially less clean than when rented.

20. Deposit

We may use your deposit to pay any amounts owed under this Agreement. If you take the vehicle outside the allowed boundary or out of the country, we will keep your deposit with no chance of refund.

21. Modifications

No term of this Agreement can be waived or modified except by a written agreement signed by both parties.
